1. These terms

These terms govern your use of chaubandiboutique.com and any purchase you make from Chaubandi Boutique. By browsing the site or placing an order, you agree to them. If you do not agree, please do not use the site.

2. Who may order

You must be at least 18 years old, or have the consent of a parent or guardian, and you must be able to enter into a binding contract. Orders ship to addresses in the United States only.

3. Products, descriptions and pricing

We describe each dress — its length, colour and fabric — as accurately as we can. Screens render colour differently, so a shade may vary slightly from what you see.

All prices are in US dollars (USD) and exclude sales tax, which is calculated at checkout where it applies. We may change prices at any time, but a change never affects an order we have already accepted.

If a product is listed at an obviously incorrect price because of a typing or system error, we may cancel the order and refund you in full, even after the order was confirmed.

4. Orders and acceptance

Your order is an offer to buy. The confirmation email acknowledges that we received it; the contract is formed when we ship the item.

We may decline or cancel an order — for example where stock has run out, where we suspect fraud, or where a shipping address cannot be verified. If we cancel after taking payment, we refund you in full.

Stock is shared with our physical shop, so an item may sell out between your order and our processing of it. If that happens we will tell you promptly and refund you.

5. Payment

Payment is taken at checkout through our payment processor. You confirm that you are authorised to use the payment method you provide.

6. Shipping, returns and refunds

Delivery times, rates and tracking are set out in our Shipping Policy. Your right to return an item, the condition it must be in, and how refunds are processed are set out in our Refund Policy. Both form part of these terms.

7. Custom and made-to-order pieces

Custom and made-to-order pieces are produced individually for you and take longer to ship. They cannot be returned for a change of mind, but they remain fully returnable if they are defective, damaged or not as described.

8. Intellectual property

The text, photographs, layout and design of this site belong to Chaubandi Boutique or our suppliers, and are protected by copyright and trade mark law. You may not copy, republish or use them commercially without our written permission.

9. Acceptable use

You agree not to use the site to break the law, to interfere with its operation or security, to scrape or harvest data from it, or to submit false or misleading information.

10. Disclaimers

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free, and we do not guarantee that every description or price is free of typographical error. Nothing here excludes any warranty that cannot be excluded by law.

11. Limitation of liability

To the fullest extent the law permits, our liability arising out of an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. This clause does not limit liability for fraud, or for anything else that cannot lawfully be limited.

12. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts and the United States, without regard to conflict-of-law rules. The courts of Massachusetts have jurisdiction over any dispute.

13. Changes

We may update these terms. The version published on this page when you place an order is the version that applies to it.
